Life Yoga Studio's Terms, Policies & Conditions

All terms and conditions from the Monthly Unlimited Auto-debit are applicable. There are a few exceptions: Absolutely NO holds or extenions on the Intro pass. This is not an auto-debit plan and requires no cancellation notice.

Member Agrees and Acknowledges that this is an auto debit plan. After commencement, the membership will continue as month to month unless cancelled. We require 30 days written notice of cancellation by email to: info@lifeyogastudio.com If your membership payment falls within 30 days, your membership will be cancelled 30 days after the payment is made and you can enjoy your last month at the end of the billing cycle. All Membership cancellations are required to fill out a short Cancellation Survey. You will receive the invote by email. Member authorizes the designated billing company selected by Life Yoga Studio Inc. to draw items (including checks, electronic funds transfer, charge card) for the purpose of paying dues for services. This includes any late fees or services fees as well as additional authorized charged purposes on the account indicated below: Subject to the following conditions: (1)The items shall be drawn on or about the date listed on the payment plan. The transactions on your statement will constitute receipts for payment. (2)If the regular payments set forth on the payment plan should vary in amount (excepting pre-authorized additional charges), you are entitled to receive notice ten days prior to the said payment. By purchasing this membership, you are authorizing to receive notice only when the said amount differs by more than $100 from your most recent payment. (3)The privilege of making payments under this arrangement may be revoked by the company if any items are not paid upon presentation. (4)If this preauthorized payment arrangement is revoked for any reason this does not release you from your obligation (payment plan). (5)A service fee will be assessed and drafted for any check, draft, credit card or order returned for insufficient funds or any other reason. A late fee will be assessed and drafted should any monthly payments become past due. (6)This preauthorized payment arrangement shall apply to the following applicants. Provided that the MEMBER is not in default of this agreement and subject to the terms and conditions hereof, the membership will automatically renew at the rate indicated below. Renewal terms may be cancelled at any time provided a 30-day written notice is delivered to the address: info@lifeyogastudio.com If you wish to cancel you may cancel by emailing Life Yoga Studio Inc. The notice must say that you do not wish to be bound by the contract. The notice must be emailed to: info@lifeyogastudio.com CANCELLATION POLICIES: Life Yoga Studio reserves the right to cancel or suspend your membership privileges for any time for any reason. If such cancellation or suspension is due to a violation of Studio policies, violations of terms or due to damages rendered by yourself or your guest, you are subject to full responsibility of the terms of this agreement along with a $55 fee and any charges for repairs to damages made. DEFAULT AND LATE PAYMENTS: Should you default on any payment obligation as called for in this agreement, Life Yoga Studio Inc. will have the right to declare the entire remaining balance due and payable and you agree to pay allowable interest, and all costs of collection, including but not limited to collection agency fees, court costs, and attorney fees. A default occurs when any payment due under this agreement is more than ten days late. A SERVICE FEE WILL BE CHARGED IMMEDIATELY FOR ANY CHECK, DRAFT, CREDIT CARD, OR ORDER RETURNED FOR INSUFFICIENT FUNDS OR ANY OTHER REASON. SHOULD ANY MONTHLY PAYMENT BECOME MORE THAN TEN DAYS PAST DUE, YOU WILL BE CHARGED A LATE FEE. If the MEMBER is paying monthly dues by Electronic Funds Transfer (EFT), Life Yoga Studio’s Designated Billing Company. reserves the right to draft via EFT all amounts owed by the MEMBER including any and all late fees and service fees. Subject to appropriate Provincial & National Law. SALES TAX: Notwithstanding any other provisions of this Agreement, you understand and agree that the amount of your monthly membership dues is based on current sales tax rates and to the extent such rates should increase during your membership, Life Yoga Studio has the right to increase your monthly membership dues by the amount of such increase. If you have requested the privilege of paying your monthly dues by pre-authorized electronic funds transfer, the monthly amount so transferred will be adjusted to reflect any increase in the sales tax rate. RIGHT TO CHANGE DESIGNATED BILLING COMPANY: The STUDIO hereby reserves the right to change the Designated Billing Company at their discretion and without warning. If such a change is made, the full terms and conditions of this agreement will continue to apply and you agree to authorize the new Designated Billing Company to continue drafting your account. NOTICE: ANY HOLDER OF THIS AGREEMENT IS SUBJECT TO ALL CLAIMS AND DEFENSES WHICH THE DEBTOR COULD ASSERT AGAINST THE SELLER OF GOODS OR SERVICES OBTAINED PURSUANT HERETO OR WITH THE PROCEEDS HEREOF, RECOVERY HEREUNDER BY THE DEBTOR SHALL NOT EXCEED AMOUNTS PAID BY THE DEBTOR HEREUNDER. MEMBERSHIP FREEZE POLICY: Please email with 15-days notice to: info@lifeyogastudio.com Memberships are alloted 1 hold per calendar year. Life Yoga Studio does not guarantee membership rates will be kept in the event of a raise in pricing in the event of cancellation. MAINTENANCE OF FACILITIES: Life Yoga Studio may be temporarily closed for periods of up to 2 weeks each year for maintenance purposes. MEMBER OBLIGATIONS: (1) MEMBER agrees to abide by all STUDIO policies, follow the directions of the staff regarding safety and security issues, and to treat the staff and other MEMBERS with courtesy. (2) MEMBER agrees to pay monthly dues on time, including notifying Life Yoga Studio Inc. promptly if banking or credit card information used for automatic payment changes, or to be charged a declined payment fee and/or a late fee per delinquent payment. (3) MEMBER agrees to pay all costs of collection incurred by the holder of this agreement if this account becomes more than 60 days past due. (4) MEMBER agrees to continue to fulfill the financial obligation of this agreement, except as allowed below. SUMMARY OF MEMBERSHIP POLICIES 1.MEMBER, by executing this Agreement, does hereby join Life Yoga Studio Inc. and such membership entitles the MEMBER to use the facilities. The MEMBER is entitled to use the facility only and MEMBER shall be required to provide MEMBER’s own athletic equipment and clothes. 2.MEMBER agrees to abide by all membership regulations of Life Yoga Studio Inc.. MEMBER agrees to comply with stated and customary rules for participation and use of equipment. Unless cancelled as provided in this Agreement, MEMBER will be responsible for all payments due and owing under this Agreement, even if MEMBER does not use Life Yoga Studio Inc.’s facilities and services. However, in the event of death or disability, liability for fees will terminate as of the date of death or disability. If Life Yoga Studio Inc. becomes temporarily unavailable due to an event such as fire, flood, loss of lease, or the life, we will extend the MEMBER’s membership privileges for the period the facilities were unavailable. 3.If MEMBER violates this Agreement and the terms contained therein or any of the rules and regulations for use of the facility, Life Yoga Studio Inc. may suspend the MEMBER’s right to use the facility until such time as the MEMBER provides Life Yoga Studio Inc. with reasonable assurance of future compliance. During the period of any such suspension, the MEMBER shall not be entitled to a credit for any prepayment of dues or other fees due or paid pursuant to this Membership Agreement. In the event MEMBER continues to violate the terms of this Agreement or the rules and regulations governing the facility, the MEMBER’s membership may be terminated by Life Yoga Studio Inc., and the balance of the contract (if applicapble) declared due and payable in full immediately. 4.MEMBER agrees that he/she shall not engage in any type of commercial or business activity while using the facilities. MEMBER shall not act as a trainer for any other MEMBERs or guests and any acts which constitute such business activities are strictly forbidden. If MEMBER engages in such commercial or business activities MEMBER’s membership shall be subject to immediate cancellation and the balance of the contract declared due and payable in full immediately. 5.MEMBER agrees that MEMBER shall abide by Life Yoga Studio Inc. dress code at all times while in the facility. 6.MEMBER agrees that MEMBER shall not use loud or profane language upon Life Yoga Studio Inc. premises nor shall MEMBER molest, badger, assault or harass other STUDIO MEMBERs, guests or employees. If MEMBER engages in such behavior, MEMBER’s membership shall be subject to immediate cancellation, and the balance of the contract declared due and payable in full immediately. 7.MEMBER understands MEMBER may be photographed at Life Yoga Studio Inc.. By execution of this Agreement, MEMBER agrees to allow MEMBER’s photo, video or likeness to be used for any legitimate purpose by Life Yoga Studio Inc., and their respective producers, sponsors, organizers and/or assigns, in their discretion. MEMBER acknowledges that by signing this Agreement, MEMBER gives up all claims of ownership, income, editorial content, and use of such media. If the MEMBER does not authorize photography, please inform us by writing to: info@lifeyogastudio.com 8.MEMBER agrees that if MEMBER fails to use Life Yoga Studio Inc. facilities that shall not release the MEMBER from the obligation to make all payments required by the terms of this Membership Agreement. 9.Arbitration: All disputes (except small claims under $1,000) will be settled by binding arbitration before a single arbitrator under the authority of the Federal Arbitration Act, conducted by and in accordance with the rules and procedures of the American Arbitration Association. The arbitration will take place in the county in which this STUDIO is located unless otherwise agreed. All arbitration proceedings must be made by an individual claimant, and will not be conducted on a “class” basis. The decision of the arbitrator must be a reasoned award. The decision of the arbitrator will be final and binding on all parties and may be enforced by a judgment entered upon the arbitration award by any state or federal court in this state. Any award from the arbitrator may be appealed under the Appellate Arbitration Rules of the American Arbitration Association. 10.Should this Agreement be placed in the hands of an attorney for the violation of any provision contained herein, the parties agree Life Yoga Studio Inc. shall be entitled to recover all costs and expenses resulting there from, including a reasonable amount as attorney’s fees. 11.The parties hereby agree that the whole agreement between the parties relating to the subject matter hereof is contained in this Agreement and shall supersede any prior understandings, arrangements, commitments, or undertakings of the parties, whether written or oral, express, or implied. 12.This Agreement may not be amended or modified except by an instrument in writing executed by the parties hereto. 13.MEMBER authorizes Life Yoga Studio Inc., and their authorized designees to contact them by email, telephone, or by other means. Subject to applicable law, Member agrees that any of these parties may contact Member at any mailing address, phone number or e-mail address set forth on the face of this agreement, or any other address subsequently provided to, or obtained by, any such party. 14.The STUDIO retains the right to modify these policies without warning. Reasonable rules and regulations may be posted in the Membership Guide or at Life Yoga Studio Inc. from time to time and all MEMBER shall be subject to strict compliance therewith. The most current copy of the Membership Guide can be found at Life Yoga Studio Inc. or at Life Yoga Studio Inc.’s website. SAFETY NOTICES •Client training services provided in this facility may be provided either by employees of Life Yoga Studio Inc. or by independent contractors operating their own business who are retained by Life Yoga Studio Inc.. Regardless, all payments for personal training services are to be made to Life Yoga Studio Inc., who will pay the trainers as the services are provided. •It is MEMBER’s responsibility to re-rack the equipment they use after each use. •MEMBER is required to use the safety features of the equipment. If you are unsure of how to use a machine, you should obtain instructions from the staff or personal trainers. •Horseplay, vulgar language, abuse of the equipment, working out while intoxicated, or other inappropriate behavior will not be tolerated and may result in the suspension or cancellation of the MEMBER’s membership, and the balance of the contract being declared due and payable in full immediately. •Cell phones are not permitted. Photography and/or videography are not allowed anywhere in Life Yoga Studio Inc.. Age Requirements – Persons under the age of 12 are not permitted in Life Yoga Studio Inc. unless they are joining a designated Kids Program.

By Purchasing these prepaid specials, member acknowledges that holds are limited to 1 week every six months, no exceptions. Member also acknowledges that no extensions, refunds, substitutions or extensions will be honored under any circumstances.

I understand the risk of injury from Yoga, Heated Yoga & Exercise activities and using any equipment may be significant, including the potential for injury or death. I knowingly and freely assume all such risks, both unknown and known. I acknowledge that I may engage in both privately supervised, group supervised or unsupervised activity and I assume all risks of using equipment, movement or exercise routines or props with or without staff present. In addition, I acknowledge that the business may include outdoor activities, which may present risks such as slippery surfaces, uneven surfaces, loose rocks/gravel, unseen landscaping issues or more. I hereby release, indemnify and hold harmless Life Yoga Studio, any additional affiliates including subcontractors, agents and the owners of this business or any other business that may be associated with this company, with respect to any and all injury, disability, death, loss or damage to person or property that may arise out of connection with this business or any use of its products, services or classes. I expressly agree that this release is intended to be as broad and inclusive as permitted by applicable law and if a portion of this release is held invalid the balance shall remain in full force and effect. This release shall apply to my heirs, assigns, personal representatives and any other next of kin. I understand that this business is relying on this release in agreeing to enter into this agreement. Life Yoga Studio Child’s Participation Liability Release  ​ 1. It is your responsibility to inform the instructor of your childs limitations before class begins. 2. I represent and warrant that my child(ren) is/are in good physical health and do(es) not suffer from any medical condition which would limit his/her participation in the classes offered at Life Yoga Studio Inc. 3. I understand that it is my responsibility to consult with a physician prior to and regarding my child(ren)’s participation in any of the yoga classes, programs, or workshops. 4. I understand the risks associated with the activities offered by Life Yoga Studio Inc. and I agree to follow all instructions so that my child(ren) may safely participate in classes, workshops, or other activities. 5. I hereby WAIVE AND RELEASE Life Yoga Studio Inc., its owners, officers, employees, and instructors from any claim, demand, cause of action of any kind resulting from or related to my child(ren)’s participation in the programs offered at the facility. 6. In taking part in the yoga classes, workshops, or other activities at Life Yoga Studio Inc., I understand and acknowledge that I am fully responsible for any and all risks, injuries, or damages, known or unknown, which might occur as a result of my child(ren)s participation in the classes, workshops, or other activities. I have read the release of liability and assumptions of risk agreement and fully understand its terms and that I have given up substantial rights by signing it and I sign it freely and voluntarily without inducement. Life Yoga Studio Code of Conduct At Life Yoga Studio, we are committed to providing a safe, inclusive, and respectful environment for all our members, staff, and visitors. We believe that yoga is not only about physical practice but also about cultivating a positive and supportive community. To maintain this atmosphere, we expect everyone associated with our studio to adhere to the following Code of Conduct: Arrive Early: Aim to arrive at least 10 minutes before class begins to settle in and prepare mindfully, minimizing disruption. Remove Shoes by the Door: Please take off your shoes and leave them by the entrance. This helps maintain the cleanliness and sanctity of the studio space. Electronic Devices: Turn off or silence phones and other devices to maintain a serene and focused atmosphere. Respect the Space: Keep the studio clean and return equipment like mats and blocks to their designated places. Personal Hygiene: Attend classes with a clean body and attire, especially in heated classes, for everyone's comfort. Fragrance-Free Policy: Please refrain from wearing strong perfumes or scents, as many individuals are sensitive to fragrances. Respect Others' Practice: Maintain quiet within the yoga room. Conversations are welcome in the lobby or other areas. Stay for the Entire Class: Try not to leave early. If necessary, inform the instructor beforehand and exit quietly. Listen to Your Body: Yoga is a personal journey. Avoid comparisons and honor your body's limits. Confidentiality and Respect: Honor the privacy and space of others. What happens in class, stays in class. Feedback and Communication: Your feedback is valuable. Feel free to speak with instructors about concerns or modifications. Inclusivity and Acceptance: Our community embraces diversity. All levels and backgrounds are welcomed. Keep an Open Mind: Be open to new experiences in your yoga journey. Share Positivity: Contribute to a positive, supportive studio environment. Sobriety is Key: For the safety and respect of all, please attend classes sober. Being under the influence of alcohol or drugs is not permitted. Respect the Instructor's Time: While our instructors are always eager to assist, please be mindful of their time after class. Lengthy conversations can be reserved for scheduled consultations or at a more convenient time. Stay Home If Ill: If you're feeling unwell, please prioritize your health and the well-being of others by not attending class. Life Yoga Studio Refund Policy 1. General Policy: Life Yoga Studio is committed to ensuring your satisfaction with our services. This refund policy outlines the terms and conditions under which refunds will be issued for our classes and services in accordance with the laws of Ontario, Canada. 2. All pricing plans are final sale. No extensions, substitutions or refunds. 3. Class Cancellation by Life Yoga Studio: In the event that Life Yoga Studio cancels a class or workshop, registered participants will be entitled to a full refund of the fees paid for that specific class or workshop. In the event that a student is using a class pass plan, the cancelled class will be credited back to the students account. The refund will be issued within 7 days of the cancellation. 4. Participant-initiated Refunds: Participants may request a refund for classes or workshops under the following circumstances: a) Medical Reasons: If a participant is unable to attend or continue with the classes due to a medical condition, a pro-rated refund will be considered for the remaining classes. A valid medical certificate or documentation from a healthcare professional may be required. b) Relocation: In the case of a participant relocating to a location beyond a reasonable distance from Life Yoga Studio, a pro-rated refund for the remaining classes or workshops will be considered. c) Discontinuation of Service: If Life Yoga Studio discontinues a particular service or class after a participant has registered and paid for it, a full refund will be issued for the fees paid for the affected service. 5. Refund Process: To request a refund, participants must submit a written request to Life Yoga Studio explaining the reason for the refund, along with any necessary supporting documentation (e.g., medical certificates, proof of relocation). Requests can be sent via email to info@lifeyogastudio.com 6. Refund Amount: The refund amount will be calculated based on the following criteria: For class cancellations by Life Yoga Studio: Full refund of the fees paid for the canceled class or workshop. For participant-initiated refunds: Medical Reasons: Refund will be pro-rated for the remaining classes or workshops from the date of the refund request. Relocation: Refund will be pro-rated for the remaining classes or workshops from the date of the refund request. 7. Refund Timeline: Upon receipt of a valid refund request, Life Yoga Studio will process the refund within 7 days. The refund will be issued using the same method of payment used for the original transaction unless otherwise agreed upon. 8. No Refund Eligibility: No refunds will be issued under the following circumstances: Failure to attend classes without providing prior notice. Participant's dissatisfaction with the teaching style or content of the classes. 9. Changes to the Refund Policy: Life Yoga Studio reserves the right to modify or update this refund policy at any time. Any changes will be posted on our website and will be effective immediately.
